We are currently looking to hire a Warehouse Manager in the Netherlands who shares our commitment to quality, responsibility, and outstanding service.
Specific Duties and Responsibilities:
1. Contract Administration and Management (Main Contracts and Subcontracts):
Proactively manage the entire lifecycle of construction contracts, including review, analysis, negotiation, administration, and closure, for both main contracts and subcontracts.
Ensure strict compliance with the terms and conditions stipulated in the main contracts and subcontracts.
Implement and maintain an efficient and transparent contract management system that allows for the monitoring and control of all contractual obligations, both at the main contract and subcontract level.
Identify, assess, and mitigate potential contractual risks in a timely manner, developing conflict prevention and resolution strategies, both in main contracts and subcontracts.
Manage contractual variations and modifications in an integrated manner, including the evaluation of their technical and economic impact, the negotiation of terms, and the formal documentation of changes, both in main contracts and subcontracts.
Prepare, maintain, and update rigorously and accurately all contractual records, including correspondence, meeting minutes, progress reports, claims, and other relevant documentation, for both main contracts and subcontracts.
Ensure the correct application of contractual clauses relating to guarantees, insurance, liability, and other relevant aspects, in both main contracts and subcontracts.
2. Specific Management of Subcontracts:
Participate in the subcontract bidding process, including reviewing documentation, evaluating bids, and selecting subcontractors.
Negotiate and draft subcontract agreements that are consistent with the terms and conditions of the main contract and that protect the company's interests.
Monitor the compliance of subcontracts, ensuring that subcontractors meet their obligations in terms of quality, deadlines, and costs.
Manage communications and coordination with subcontractors, resolving any problems or conflicts that may arise.
Evaluate the performance of subcontractors and provide feedback to improve their performance.
3. Communication, Coordination, and Liaison:
Act as the primary point of contact for all communications and inquiries related to contractual matters between the company, the client, subcontractors, suppliers, and other stakeholders.
Establish and maintain fluid and effective communication with project teams (engineering, purchasing, construction, quality, etc.) to ensure understanding and compliance with contractual requirements.
Coordinate and collaborate closely with the engineering, purchasing, legal, and finance departments to ensure consistency and alignment in contract management.
Actively participate in project meetings and provide expert advice on contractual matters.
4. Negotiation and Conflict Resolution:
Actively participate in the negotiation of contracts with clients and subcontractors, seeking to obtain the best possible conditions for the company and protecting its interests.
Negotiate settlement agreements for disputes and claims, seeking fair and equitable solutions for all parties involved.
Represent the company in mediations, arbitrations, or other dispute resolution proceedings.
5. Claims Management:
Manage comprehensively and proactively all contractual claims, both those originated by the client and those submitted by subcontractors, from receipt to final resolution.
Evaluate the validity and impact of claims, collecting the necessary documentation and evidence to support the company's position.
Prepare and submit claims to clients or subcontractors, following the procedures established in the contracts.
Negotiate settlement agreements with the aim of resolving claims amicably and avoiding costly litigation.
6. Legal and Regulatory Compliance:
Ensure strict compliance with all local, national, and international laws, regulations, and standards applicable to construction contracts and subcontracts.
Stay up-to-date on changes in contract law and industry best practices.
Advise project management on legal and regulatory aspects relevant to contract management.
Collaborate with the legal department to ensure the protection of the company's rights and interests.
7. Reporting and Analysis:
Prepare periodic reports and detailed analyses on the status of contracts, identified risks, outstanding claims, and other relevant aspects, for both main contracts and subcontracts.
Provide contractual analyses to support strategic decision-making by project management
Develop and maintain key performance indicators (KPIs) to measure the effectiveness of contract management.
Essential Requirements:
Academic Background:
University degree in Law, Civil Engineering, Business Administration, or related discipline.
Desirable: Master's degree or postgraduate specialization in Contract Law, Construction Management, or related areas.
Professional Experience:
Minimum of 15 years of demonstrable experience in the management of large-scale construction contracts, preferably in industrial revamping projects or similar, including specific experience in the management of subcontracts.
Proven experience in international projects.
Thorough knowledge of the different contracting methods (EPC, EPCM, etc.) and the main contract models (FIDIC, NEC, etc.).
Technical Knowledge and Skills:
Expert command of the principles and practices of contract management and subcontract management.
Excellent negotiation, communication (oral and written), and problem-solving skills.
Demonstrated ability to work independently and in a team, managing multiple tasks and priorities efficiently.
Proficiency in the use of contract management software and computer tools (MS Office, etc.).
Languages:
Essential: Bilingual proficiency (native or equivalent) in English, both spoken and written. The ability to draft and negotiate contracts and subcontracts in both languages will be valued.
Valuable: Knowledge of Nederlands and Spanish.
